Selling a Parent's Home When They're in Assisted Living

This situation is more common than most families expect. A parent transitions to assisted living — sometimes quickly, following a health event — and the family is left managing both the care transition and a home full of belongings that needs to be sold. Here's what families in this situation need to know.

Who Has Legal Authority to Sell?

This is the first question to answer. If your parent is still mentally competent and simply physically unable to manage the sale, they can sign a power of attorney authorizing you to act on their behalf in real estate transactions. Indiana's power of attorney statute (IC 30-5) allows for a durable power of attorney that remains in effect if the principal later becomes incapacitated.

If your parent has already lost mental capacity and no power of attorney was established, you may need to petition for guardianship through St. Joseph County court — a process that takes several months. Don't sign anything or accept any offers until authority is legally established. Doing so could expose you to liability and cloud the title.

Medicaid and the Home: What Families Often Don't Know

If your parent is receiving or may apply for Medicaid to cover assisted living costs, the home's sale may affect their eligibility or trigger estate recovery. Indiana's Medicaid rules exempt a home as an asset while the owner has intent to return — but once the home is sold, proceeds count as assets and can affect Medicaid eligibility.

More importantly, Indiana participates in the Medicaid Estate Recovery Program (MERP), which means the state can seek reimbursement from the estate for Medicaid costs paid. If Medicaid has been covering care, the state may place a lien on the home. This must be addressed before or at closing. Talk to an elder law attorney before you proceed with the sale — this is non-negotiable if Medicaid is involved.

Managing the Contents: A Real Challenge

Clearing out a longtime family home is emotionally and physically exhausting. Before you call a junk removal company, walk through carefully. Consider bringing in a certified personal property appraiser or estate sale company — they often find value in items that look like ordinary belongings. Document what's in the home for insurance and accounting purposes, especially valuable items.
