What is different is the house. Goshen has a lot of older homes, a river and several creeks running through town, and a city building department that keeps permit records. Each of those can shift what the house is really worth to the spouse who wants to keep it.
Three Goshen Checks Before Anyone Agrees to a Buyout
1. Is it in a mapped flood hazard area? The Elkhart River flooded in February 2018 and the City of Goshen reports that the flood damaged 300 properties. The city's flood zone page uses FEMA data to show where risk is highest, and its 2022 Flood Resilience Plan identifies flood-prone neighborhoods. If the house sits in a FEMA special flood hazard area, a federally backed or regulated mortgage used to refinance it into one name will generally require flood insurance, and that premium belongs in the buyout budget.
2. Was the work permitted? Goshen's Building Department requires permits for roof replacement, siding, windows and electrical, mechanical or plumbing work, and it runs an online permit portal. A finished basement, a new deck or a rewired kitchen with no permit behind it can cause trouble with an appraisal or a future buyer's inspection โ and a spouse keeping the house inherits that problem.
3. Whose name is on the utilities? Goshen's water and sewer accounts are billed by the city. If the account is in the name of the spouse who is leaving, arrange a change when they move out. Unpaid municipal sewer charges can become a lien on the property itself, which is a debt both owners carry until the house is sold or refinanced.
If One of You Keeps It โ or You Rent It Out for a While
A buyout is a good outcome when the spouse keeping the house can refinance alone, the flood and permit checks come back clean, and the budget still works with insurance and maintenance included.
Some couples instead agree to hold the house and rent it until the market or the children's schedules make selling easier. In Goshen, that means both owners are landlords: rental property must be registered with the Building Department and inspected, with annual fees, and any work needed to pass is a joint expense. Before you choose that route, agree in writing who handles the tenant, the inspection and the repairs. Disputes over those are common.

Put the Goshen Details in the Agreement
Settlement agreements usually say who gets the house or how the proceeds split. They often say nothing about the practical questions that come up while the house is still jointly owned. In Goshen, it is worth adding a few lines that cover them:
- Who receives city mail. Notices from the Building Department or the utility billing office go to the owner of record. If the spouse on the notice has moved out, agree how it gets passed on.
- Who pays the water and sewer bill until closing or refinance, and what happens to any balance at that point.
- Who handles maintenance. Goshen's Neighborhood Preservation Ordinance applies to occupied and empty houses alike, so a leaking roof or broken window is a shared liability until one of you owns the house alone.
- Who checks the basement after heavy rain if the property is near the river or a creek and neither of you is living there.
- A deadline for the refinance. If one spouse is keeping the house, set a date by which the refinance must close, and what happens โ usually a sale โ if it does not.
Your attorney or mediator will know how to word these. Raising them early prevents the most common post-decree argument: who was supposed to deal with the house while everyone waited.

The closing is handled by a title company, which pays the mortgage, any city balances and closing costs, then splits what is left exactly as your agreement or decree says.
